S.C. CHIEF JUSTICE ADDRESSES CASE BACKLOGS, NEW COURT FEE
The chief justice seeks a total budget of $69.3 million for the court system for fiscal year 2014, which starts July 1, the same amount in this fiscal year’s “actual” budget, according to Office of State Budget (OSB) records.

Those documents show that the Judicial Department’s budget is comprised of about $45 million in general funds, $20.5 million in “other” funds, and $3.8 million in federal funds.

A chart that Toal provided the subcommittee shows a growing and heavy reliance on court fines and fees, which make up other funds. Those collections climbed from $2.8 million in fiscal 2002 to $18.7 million in fiscal 2010.

Last fiscal year, the department collected nearly $23.4 million in other funds, OSB records show.

Toal acknowledged that fees and fines are a significant revenue generator.

“The court system top to bottom generates a lot more than it takes to run them. This is a revenue source for the state, big time,” she said.

The chief justice, however, made no mention of lowering or eliminating any court fees.

The state court system relies on counties and municipalities to collect the system’s share of fee and fine money, and send it to the (S.C.) Treasurer’s Office, Toal said, adding there is a problem with some local jurisdictions retaining the court system’s portion.

Here is a list of municipalities that have failed for at least one year to provide the state with required audits of fee and fine money.

RODMAN STYLE TROUBLE COMING FOR CROMARTIE

 

Fox Sports reports: 

New York Jets cornerback Antonio Cromartie, 28, recently had his second child with wife Terricka, making it 10 kids from eight women in six states. 

Their baby boy, Jagger, joins sister Jurzie and eight half-siblings from Cromartie baby mamas across the country. 

But the happy occasion is mixed with turmoil. His far-flung fatherhood has intrigued a TV production company that wants to create a reality show about the group "trying to co-exist as a modern family," a source said. 

Most of the moms want to do the show, but Cromartie said no. 

The baby mamas he left behind have banded together so their kids can bond with their brothers and sisters in California, Texas, Florida, Georgia, North Carolina and New Jersey. 

The single women can use the extra money to help raise their kids, but they also think it is important "to document their journey," the source said. "They want Antonio's support."Cromartie has deflected the plan, blocking any filming of his offspring. 

This story appears to be headed towards a Dennis Rodman style unhappy ending.

STATUS OF BARDES V. MAGERA, ET. AL.

While this outcome was predictable, particularly in view of the fact that Mr. Bardes elected to represent himself, Mr. Bardes appears to have raised some legitimate issues that were never addressed by the Court.

DSS RESPONSE TO BUDGET PROVISO 26.20 VS. E-MAIL

Those who compare the Department of Social Services Response to Budget Proviso 26.20 with the e-mail sent by DSS will note that the former leaves out the following language:
What is the maximum penalty that could be assessed?

The maximum penalty is the disapproval of the State’s Child Support Enforcement (Title IV-D) State Plan. This would result in the withdrawal of all federal funding for the State’s Child Support Enforcement program of approximately $22.8 million and over 200,000 child support cases annually. The second level of penalty would be the disapproval of federal funding for the Temporary Assistance for Needy Families (TANF) program, potentially $99 million annually.
While we question the accuracy of the information in the DSS e-mail, it is more comprehensive than the information provided to the entire General Assembly and underscores the pressing need to commit whatever resources are needed to put this system in place as soon as possible. Perhaps if DSS Director Koller would share this information with the entire General Assembly, DSS would receive adequate funding to do its job. As it stands, DSS is apparently utilizing much of the $22.8 Million it receives each year from the federal government for the Child Support Enforcement Program for other purposes.

MOTHER FACES CONTEMPT & JAIL FOR BAPTIZING CHILDREN WITHOUT CONSULTING FATHER

According to FOX News:
Shelby County mother faces contempt-of-court charges and possible jail time for baptizing her two children without the knowledge or consent of her ex-husband. This week the Tennessee Court of Appeals said Lauren Jarrell must face a criminal contempt hearing for violating a court order that said major decisions regarding the religious upbringing of her two children should be made jointly with the children's ather.

We are not sure what purpose jailing the mother will serve or why the father would want to pursue contempt charges under the reported facts of the case. This case appers to be much different than the case discussed here.

DENNIS RODMAN IS SICK, BROKE, & CAN'T PAY CHILD SUPPORT

The Los Angeles Times has reported that former NBA star Dennis Rodman is facing contempt charges for owing over $800,000 in back child support.
